Terms of Service

These Terms of Service ("Terms") govern your use of the website at bycast.app (the "Site"), operated by Bycast ("Bycast," "we," "us," or "our"). By accessing the Site or submitting an early-access application, you agree to these Terms.

1. Eligibility

You must be at least 18 years of age to use the Site or apply for early access. By submitting an application, you represent that you are 18 or older, and that you are not located in, or a resident of, any country subject to comprehensive sanctions by the United States, the European Union, Switzerland, or the United Nations.

2. What the Site is

The Site is a pre-launch informational page for Bycast. It allows visitors to learn about the product and apply for early access to a closed beta. Applying does not guarantee access. We may grant, delay, limit, or deny access at our sole discretion.

The Bycast application has not launched. When it does, it will have its own terms covering accounts, staked claims, resolution, and the handling of digital assets. Those terms will govern your use of the application. Nothing here grants you any right to use it.

3. Early-access applications

When you apply for early access, you provide your email address, topic preferences, and intended usage. By submitting, you agree to receive a confirmation email and, if accepted, an invitation to the beta. You can leave the waitlist at any time by emailing info@bycast.app.

4. No guarantees, and things may change

The Site is provided on an "as is" basis, without warranties of any kind, express or implied, to the fullest extent permitted by law. We make no guarantees regarding:

• The timing or availability of beta access.
• The features, functionality, mechanics, or availability of the Bycast product.
• The accuracy or completeness of information on the Site.

The Site describes a product under development. Features, mechanics, timelines, and terminology described on it are subject to change, and some may never ship. Do not rely on any description of a future feature.

5. No advice, no offer

The Site is informational. Nothing on it is financial, investment, legal, or tax advice, and nothing on it is a recommendation to enter into any transaction.

Nothing on the Site is an offer to sell, or a solicitation of an offer to buy, any security, token, or financial instrument, in any jurisdiction.

6. Intellectual property

All content on the Site — including text, graphics, logos, images, and design — is the property of Bycast and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any content on the Site without our prior written consent.

7. Acceptable use

You agree not to:

• Submit false or misleading information in your application.
• Submit applications on behalf of others without their permission.
• Attempt to submit multiple applications to manipulate waitlist positioning.
• Interfere with or disrupt the Site or its infrastructure, or attempt to gain unauthorised access to any part of our systems.
• Use the Site for any unlawful purpose.

8. Limitation of liability

To the fullest extent permitted by law, Bycast and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, revenues, data, or goodwill, arising from your use of the Site or inability to access the beta. Our total liability arising from the Site is limited to USD 100.

Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

9. Privacy

Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

10. Modifications

We may update these Terms at any time. If we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

11. Governing law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. If you are a consumer resident in the European Economic Area, the United Kingdom, or Switzerland, this does not deprive you of the protection of the mandatory laws of your country of residence.
